Texting driver not criminally responsible in Route 17 crash that killed Elmwood Park motorcyclist, police find

UPDATE: A texting driver who caused a multi-vehicle crash that killed an Elmwood Park motorcyclist on Route 17 in Paramus wasn’t responsible for his death, a law enforcement source told CLIFFVIEW PILOT .

Investigators determined that Michael Miktus, 33, couldn’t stop his cycle in time because he was following too closely, the source said.

So while Nadine Nixon, 21, of Franklin Lakes received summonses for reckless driving, texting while driving and tailgating, she wasn’t criminally charged.

“Stopping short caused the wreck because of texting, but not the death,” the source said. “It was determined that the bike should have been able to stop in time. It was following too closely.

“Which means she caused the crash but not the fatality.

“He knew he couldn’t stop in time, so he laid the bike down,” the source told CLIFFVIEW PILOT . “The peg caught and flipped him between two other cars.”

Miktus sustained massive trauma and severe blood loss in the 1:45 p.m. pile-up involving his cycle, Nixon’s Jeep, a Toyota Sienna minivan, a BMW sedan and a Lincoln MKX owned by a limo company, near the Staples Shopping Center and A&S Drive on the southbound highway.

Nixon also was charged with obstruction of justice, according to police. They said they couldn’t elaborate, however, noting that an investigation was continuing.

A third motorist, 29-year-old Alyssa Dabronzo of Lodi, was issued summonses for careless driving and following too closely.

Miktus, who turned 33 on Thursday, was “a bright, charismatic loving man who is survived by extensive family and countless friends who will miss him dearly,” his brother, Matthew, told CLIFFVIEW PILOT this afternoon.

Joining Paramus police at the scene were the Bergen County Prosecutor’s Fatal Accident Investigation Unit and the Bergen County Sheriff’s Bureau of Criminal Identification. Also there were The Valley Hospital paramedic unit and the state Department of Transportation. The highway was closed more than four hours, from 1:45 p.m. to 6:05 p.m.

The left and center lanes were closed for more than two hours during the investigation.
